Privacy policy

iChoice Co., Ltd. (NICH TEC) ("we") is the data controller for nichtec.com. This policy explains how we collect, use and disclose your personal data under Thailand’s Personal Data Protection Act B.E. 2562 (2019).

1. What we collect

  • What you send us through the contact form, or when you send a design to our team: your name, phone or LINE ID, email, business or agency name and your message. When you send from the design assistant, this includes your answers and the design.
  • What you type into the design assistant. Your type of business, what you want a system to do and your answers are sent to an AI provider so it can ask questions and design the system. We don’t store your original text unless you send the design to our team. We do keep the AI’s output for a short time, which may include parts of what you typed, so identical requests are answered faster and at lower cost.
  • Technical data: your IP address, which we hash before storing to enforce usage limits, one strictly necessary cookie that lasts one day and counts uses per device, and our hosting provider’s access logs.

2. Why we use it, and the legal basis

  • To reply to you and provide what you asked for, including preparing a quote. This is based on steps taken at your request before entering a contract (section 24(3) of the PDPA).
  • To ask questions and design a system when you use the design assistant. This is based on steps taken at your request before entering a contract (section 24(3)).
  • To prevent abuse of the design assistant and forms and keep the site secure. This is based on our legitimate interests (section 24(5)).

3. Service providers we share data with

  • OpenAI (USA) processes what you type into the design assistant with its AI models through its API. OpenAI does not use API data to train its models. We also send a hash of your IP address (not the address itself) so OpenAI can detect abuse.
  • Cloudflare, Inc. (USA) verifies that users are human (Turnstile) and, if enabled, provides cookie-free visitor statistics.
  • Our hosting and email providers, to receive and deliver the messages you send.

Data is transferred to providers abroad only as far as needed to deliver the service you request.

4. How long we keep it

  • Form submissions and designs you send to our team: up to 2 years, unless we enter into a contract.
  • AI output from the design assistant: deleted automatically within 14 days, and never linked to your name or contact details.
  • Hashed IPs and usage counters: deleted automatically within 7 days.
  • OpenAI keeps abuse-monitoring logs for up to 30 days, unless the law requires longer. We set it not to store responses for later retrieval.

5. Your rights

You may request access to, a copy of, correction or deletion of your data, restrict or object to processing, request portability, and withdraw consent at any time by emailing info@nichtec.com. You may also complain to Thailand’s Personal Data Protection Committee.
